Peace Officer Davey explains how to fight a claim of "failure to comply with a school attendance order" WITHOUT providing any physical evidence of home education. If you are considering home education for your children, you should provide a comprehensive testimony to the Local Education Authority of your child's education and what subject matter you will be covering. Although there is NO LEGAL DUTY under ANY education law to communicate on ANY level with the local authority, it would be wise to do so on at least one occasion so that it cannot be argued that you provided no evidence. It's important to understand that your oral or written evidence is considered to be acceptable evidence in a court of law. In the absence of a provable rebuttal to your testimony, your word should not be questioned or doubted. Only where there is NO communication and a complete refusal to communicate on ANY level with regards to your child's home education, you could lose your case against a SAO, as the judge or Magistrate would deem it reasonable for the local authority to deduce that, based on zero evidence provided to the contrary, it was entitled to conclude that home education was likely not being provided (see Philips v Brown [1980]). As long as you provide them with oral or written evidence, you will win your case. Here is the official government guidance booklet for you to download and use in your defence, using page 14 paragraph 5.4 to prove that you are not obliged to agree to a home or other location appointment, or provide ANY evidence, including physical hardcopies:
